I was served a summons with a credit card transaction sheet but payments I made to the account are missing.7/29/2008 6:55:39 AMYou may occasionally find an attachment to your summons listing the transactions associated with the past due account. The attachment is basically a printout of the transactions and will not be actual credit card statements or invoices. If you’re being sued by a debt collection attorney, who is representing your creditor, and the attachments list debts but not credits, then you can raise the defense of payment in court. You may want to get past bank statements or canceled checks as supporting evidence. Comments
