Is my spouse responsible for any of my debts?

Your spouse cannot be responsible for a debt that his or her name is not on. In certain circumstances if you have added your spouse--even unmarried--to your account as a joint accountholder, then he or she will become liable at that point in time. Even if you have added your spouse as a joint accountholder after the debt was instated your spouse would be liable for that debt also. So in other words whatever your debt status is at the time that you add a joint accountholder, then that is when the joint accountholder will be responsible for the specified debt also.

What about community property? Attorney's in CA can get a court order allowing the garnishment of a spouses wages, even if they are not on the judgment.
